1.0 Operational ownership

1.1 This website is operated and owned by MAAP Accountancy Services Ltd t/a Construction Site Health and Safety Consultants (henceforth referred to as 'CSHAS' in the remainder of this document).

1.2 The operation of this website is covered by our registration with the Information Commissioner’s Office under the Data Protection Registration Reference ZA032689.

1.4 Telephone enquiries concerning the content of this website can be made to telephone number +44(0)1202 482121 during normal office hours, Monday to Friday.

1.5 By accessing and continuing to use any part of this website, visitors shall be deemed to have accepted and be bound by these terms and conditions.

1.6 This agreement represents the complete agreement and understanding between CSHAS and any visitor to this site.

1.7 Any new features added to the site in the future, shall be subject to the same terms and conditions, unless otherwise stated.

2.0 Operational continuity

2.1 We will take reasonable steps to ensure the library content is available during the period of your subscription, but we do not provide any minimum guaranteed up-times for service availability.

3.0 Operational efficiency

3.1 The speed at which you will be able to download our videos will be subject to a range of factors beyond our control. We will continue to monitor technological advances in video compression techniques and availability of new hosting services to maximise efficiency and minimise download times.

3.2 As the user of our services you have to accept sole responsibility for choosing a suitable broadband connection that allows you to download our library and video content over the Internet. You will need a reliable and reasonably fast broadband connection to make best use of the high quality video service we provide.

4.0 Refund policy

4.1 Once you have subscribed and accessed the online service you will be able to view all the material within the library available to your level. We therefore consider that CSHAS's contractual obligation to provide the designated service has been met and fully discharged on the first occasion you access the system. The fact that you can continue to return to the website and enjoy the convenience of accessing the same, or perhaps new material, for a period of one year is incidental to the contract for services between us.

4.2 For this reason, CSHAS will not make refunds to subscribers who no longer wish to use the service once they have accessed the service for the first time.

5.0 Intellectual Property Rights and Copyright

5.1 All intellectual property rights and copyright to the design, methodologies, technologies, imagery and text content are reserved by CSHAS (and its licensors). They are non-transferable.

5.2 Clients may request we make available their own health and safety documents for which they will retain copyright of those documents.

5.3 Although clients may claim copyright for specific documents, their legal right to do so may be compromised by so many other existing publications that use almost identical styles and formats of presentation, imagery and text content. By agreeing to publish their documents on this website, clients indemnify CSHAS against any claim for legal costs or losses arising from breaches of copyright or intellectual property rights brought against their material published on this website.

5.2 Visitors are NOT permitted to download and print extracts from this site, other than their own library of documents supplied for that purpose.

5.4 No part of this website can be reproduced or stored in any public or private retrieval system or service without the express written permission of CSHAS.

6.0 Privacy and how we use the personal information you supply

6.1 This notice applies to all potential information that could be collected directly from this website.

6.2 CSHAS does not knowingly intend to collect, or use, any identifying information about who visits this website.

6.3 Although the matter is beyond our control, it is prudent to remind visitors that it is almost certain that your visit and activity on our website is being recorded and analysed, to a greater or lessor extant, by the providers of the hosting services we all use, and the search engines and/or web browsers you choose to navigate around the Internet.

6.4 The introduction of GDPR in May 2018, has only served to highlight just how much personal detail is collected by various third parties about our use of the Internet, and how little control we have over how that information is used. In the main, the identifying and non-identifying information collected by these various agencies are used with the intention of improving our collective experience of using the Internet. One cannot help but conclude, however, that no amount of UK (EU-wide) legislation is going to stop the continuing misuse of your personal information on the world-wide platform. The only statement any responsible website operator can make with authority, is that they respect your right to privacy and nothing has been included in the coding over which they have control to compromise that right to privacy … as is the case here.

6.5 If a person signs up to subscribe to one of our services published on this website, they will be asked to supply their business name and address, a contact name, email and telephone number. This information will be stored within a secure, online database designed to provide us with the details we need to raise and send an invoice and create the password-protected facility to allow them to access the secured areas of this website for the duration of their subscription period.

6.6 The information collected about our subscribers will not knowingly be shared or used for any purpose other than those stated in section 6.5 above. Only trained and authorised IT staff can access the online data, and we continuously review the security measures of our operation, the hosting companies and software we use to publish this website to reduce the chances of unauthorised access.

6.7 We use the independent, third-party PayPal online payment system to collect any amounts due from clients as they sign-up to our subscriptions services. CSHAS does not have access to any of the details of the online financial transaction at the time of processing. Consequently, the information CSHAS will store online will never include any 'sensitive' financial information about our clients' bank accounts, debit and credit cards used to pay for our services.

6.8 Subscribers should refer to PayPal's privacy policies for details of how the information they provide to complete their financial transaction will be stored and used by them.

6.9 We reserve the right to use the contact information you provide us to keep you informed about changes to the subscription service you have signed up to during the term it is active. We shall send a subscription renewal reminder one month before your service is due to end. We will also send you a reminder email after your subscription has ended inviting you to renew.

6.10 We shall delete details of expired subscriptions from our online database after one year.

6.11 If you do not wish to receive future emails containing information about the additions or improvements to our services and products, we shall include a means of unsubscribing so you can remove your details from our records.

6.12 To prevent unauthorised access, maintain data accuracy, and ensure the appropriate use of information, we have put in place appropriate physical, electronic, organisational and managerial procedures reasonably designed to safeguard and secure the information we collect about subscribers. Although we regularly review our policies and procedures, the storage of information on on-line servers and the transmission of data over the Internet is inherently insecure. For this reason it is impossible for any website operator to guarantee the security of your online data. That said, the information we do store is arguable already freely available on the Internet, and an authorised breach of that data would be of little consequence in the event.

8.0 CSHAS is committed to observing all GDPR procedures. We have clear policies and processes in place within our organisation to ensure we comply, and we will exercise responsibly our duties as a data controller and data processor.

8.2 We will comply with all reasonable requests from individuals to confirm the information we hold on them as required by the GDPR. We can confirm in advance that the only information we retain on records are the details of subscriber since May 2018, which is limited to their business name and address, a contact name, a telephone number and email address.

9.0 Use of Cookies

9.1 The only cookies this website knowingly deploys are temporary session cookies that allow registered subscribers to securely access the password protected areas of this site. They are not designed to collect any information about you or your equipment, and they cease to be active as soon as you close your browser session, or elect to log-out of our system.
